Recognized Sources for Foreign Price Verification and Formulas: 2017

France

The recognized price source for France is Vidal that publishes “PFHT” in Euro (EUR) which is the ex-factory wholesale price (WP) for reimbursed drugs. Vidal also publishes “Px-Retro” which is the ex-factory hospital price (HP) for drugs that can be dispensed to out-patients by hospitals. Patentees should report only the “Px-Retro” when both the “Px-Retro” and “PFHT” are published.

Germany

The recognized price source for Germany is Lauer-Taxe that publishes the manufacturer’s list price of drugs in Euro (EUR). Board Staff may derive the ex-factory wholesale price (WP) by subtracting statutory rebates from the list price. The formula is:

  • WP = APU - Pflichtrabatt des pharmazeutischen Unternehmers (PDPU)

The manufacturer’s mandatory rebates to health insurers and statutory health insurance funds are 7% of the list price, excluding the 19% value-added tax (VAT). A separate mandatory discount of 10% applies for generics and off-patent innovator drugs, plus an additional 6% discount on non-reference priced generics and non-reference priced off-patent originals. For vaccines, the rebates correspond to the difference between the ex-factory price in Germany and the average European price, and vary between 0.4% and 18.6% depending on the drug in question.

Lauer-Taxe also publishes the ex-factory hospital price, known as “Taxe-Klinik EK” which is subject to the mandatory rebates described above.

Italy

The recognized price source for Italy is L'Informatore Farmaceutico that publishes “Prezzo Ex-factory” in Euro (EUR) which is the ex-factory wholesale price (WP) for reimbursed essential drugs (Class A) and the ex-factory hospital price (HP) for reimbursed hospital drugs (Class H).

Sweden

The recognized price source for Sweden is the Dental and Pharmaceutical Benefits Agency (Tandvårds- och läkemedelsförmånsverket, TLV) that publishes “Apotekens inköpspris, AIP” in Swedish krona (SEK) which is the ex-factory pharmacy price (PP) for reimbursed drugs.

Switzerland

The recognized price source for Switzerland is the Federal Office for Public Health (Office fédéral de la santé publique, OFSP) also known as Bundesamt für Gesundheit (BAG) that publishes the ex-factory wholesale price (WP) for reimbursed drugs in Swiss franc (CHF).

United Kingdom

The recognized price source for the UK is Monthly Index of Medical Specialties (MIMS) that publishes the manufacturer’s list price in British pound (GBP). The manufacturer’s list price is treated as an ex-factory pharmacy price (PP).

United States

The recognized two price sources for the US are the Red Book and the Department of Veterans Affairs (DVA) Federal Supply Schedule (FSS). The Red Book publishes a wholesale acquisition cost (WAC) price which is equivalent to an ex-factory wholesale price (WP). The Red Book also publishes a direct price (DP) which is equivalent to an ex-factory pharmacy price (PP) as well as an ex-factory hospital price (HP). The DP can be used as a WP if there is no WAC price. The FSS price should be reported as “Other-FSS”. The prices are reported in US dollar (US$).
